    I am Daci L. Jett, the managing attorney at Daci Jett Law LLC, an estate planning, probate, and trust administration law firm.

    For estate planning, we have an initial consultation to meet the client and determine their needs, and then I recommend a type of estate plan and quote a fee. After the client engages me, we have an in-depth discussion to design the estate plan. I will listen to understand what you want, and do my best to see your wishes are carried out. I will put together a plan that works for you and is designed to save your family money and difficulty down the road.

    You review your draft documents with us to make sure they accurately reflect your wishes.

    Signing

    You sign your estate plan with our supervision, in front of two witnesses and a notary public.

    Funding

    We do not just give you an estate plan – we also provide detailed instructions for how to implement your plan so it actually works for you and your family. This is a very important step.

    What is estate planning?

    Estate planning is the process of arrange for the transfer of your personal wealth. The primary goals are to ensure that the property will pass to designated recipients in the appropriate form and to minimize taxes and other costs. Additionally, estate planning can protect assets that pass to beneficiaries from creditors or a spouse in the event of divorce.

    Why is estate planning important?

    Estate planning is important because it ensures that your assets are distributed according to your wishes, minimizes taxes and other costs, and can protect your beneficiaries' inheritance from creditors or divorce. Without proper estate planning, your assets may not be distributed as you intended, and your estate may incur unnecessary taxes and expenses.

    What documents are typically included in an estate plan?

    A typical estate plan includes a will, sometimes a living trust, sometimes a guardianship nomination for minor children, a healthcare power of attorney, and a financial/property power of attorney.

    What is a living trust?

    A living trust is a legal arrangement created during a person's lifetime that allows them to transfer assets into the trust for their benefit during their lifetime and then transfer those assets to designated beneficiaries upon their death, bypassing probate.

    What is the difference between a will and a living trust?

    A will is a document that directs how your assets are distributed after your death and typically requires probate. A trust also directs how your assets are distributed after your death, but typically can avoid probate, which provides more privacy.

    Do I need a certain amount of assets to create a living trust?

    No specific amount of assets is required to create a living trust. A living trust can be beneficial for managing and distributing any level of assets efficiently.

    How often should I update my estate plan?

    You should update your estate plan whenever there are significant changes in your life, such as marriage, divorce, the birth of a child, or significant changes in your financial situation. Additionally, it is advisable to review your estate plan periodically, such as every five years, to ensure it remains current with any changes in laws or personal circumstances.

    Are online DIY estate planning tools a good idea?

    In a word, no. Estate planning involves several legal subjects that all come together, and most people do not have the knowledge to address all the necessary subjects. Additionally, online DIY tools often produce only simple documents that lack the customization and nuance that you may need. Consulting an estate planning attorney ensures your unique needs are addressed, and in a way that works for you and your family.

    Why can’t I write my own will or trust?

    You can, but it is not a good idea. Writing your own will or trust without legal guidance can lead to errors and omissions that may invalidate the document or cause disputes. Creating a trust or a valid will requires specific elements that are best handled by a professional.

    Can we meet with you over the phone?

    We meet with clients and prospective clients either over video and in person. We do not meet over the phone.

    Does my spouse have to come to the meeting?

    If your spouse want us to prepare an estate plan for them, then yes, your spouse must come to the meeting. If you want us to prepare an estate plan just for you, and you want my duty of confidentiality to exclude your spouse, then come by yourself.

    What is a living trust?

    A living trust is an agreement between the Grantor (who creates the trust) and a Trustee (who administers the trust) for the benefit of the Beneficiary. Oftentimes, the Grantor, Trustee, and Beneficiary are the same individual at the beginning. I sometimes describe it as taking money from one pocket and putting it into your other pocket. The living trust contains instructions for the Trustee to follow in administering the trust during the Grantor’s life, which becomes useful if the Grantor can no longer manage his own affairs. It also contains instructions for how to distribute the assets in the trust after the Grantor’s death. A living trust has built-in disability protections in case a Grantor becomes incapacitated during life, and functions as a will-substitute after death to avoid probate. A living trust is especially useful for avoiding multiple probates if a person owns real estate in more than one state.

    What happens to my property and my children if I do not have a will?

    That is determined by the state you live in when you die. In Illinois, if you are married and have children, half the assets you own in your name go to your spouse and the other half go to your children. If your children are minors, their inheritance will probably be placed in a court guardianship and given to them in a lump sum when they are 18. Most 18-year-olds are not mature enough to manage a windfall, and taking this approach can result in serious negative consequences.

    Do I need a certain amount of assets to create a living trust?

    No. Your goals and the types of assets you own are more important in determining whether a living trust is right for you. This is one reason I ask my clients about their assets.

    My relative left a very small estate. Do we still have to go to court?

    We can discuss whether that option is right for you. You may be able to avoid going to court.

    How can I be sure mediation will produce a fair result?

    With mediation, the people involved in the conflict determine the result, not an outside party. If you do not believe an outcome is fair or good for you, then do not agree to it. In mediation, you are not forced to agree.

    How long does mediation take?

    Many cases can be resolved in one day. Divorce and custody issues often take many shorter sessions because there are so many issues to resolve and so much information the parties must consider.

    Can we meet with you over the phone?

    It is not possible to have an effective consultation over the phone. Estate planning deals with important issues like family dynamics, who will receive all your money, and who has the power to control your personal care and your money if you become disabled. Unfortunately, there is a risk of abuse or duress when it comes to money and control within a family. I need face-to-face conversations with my clients in order to be sure I understand their situation, to be sure they understand what we are doing, and to be sure they are expressing their own wishes.

    Does my spouse have to come to the meeting?

    If your spouse wants me to prepare an estate plan for him/her, then yes, he/she has to come to the meeting. I cannot prepare an estate plan for a person without meeting face-to-face with him or her. If you want me to prepare an estate plan just for you, and you want my duty of confidentiality to exclude your spouse, then come by yourself.

    Why do we have to go through probate if there is a will that says how to distribute the assets?

    First, a court must confirm that the will is valid and that it is actually the last will and not an earlier will. Then, certain people must be given the opportunity to object to the will. Also, all of the deceased person’s financial affairs must be finalized before the assets can be distributed. There might be claims against the estate, such as unpaid bills or debts, that affect what beneficiaries receive. The executor must identify and pay outstanding bills and debts, collect debts owed to the deceased, and might need to finalize a contract, or close or sell a business.

    Why can’t I write my own will or trust?

    You could, but the risk is you don’t know what you don’t know. The value I provide my clients is in my counseling, which combines my knowledge, experience, and judgement. In a sense, the documents are free; it’s the counseling you pay for.

    If I choose mediation, do I need a lawyer?

    That is your decision. Most of the time, you do not need a lawyer to be there with you, for two reasons. First, in mediation, the parties are trying to work together to solve their conflict, not trying to convince a judge or arbitrator of their point of view. Second, the rules in mediation are few and easy to understand. That said, if you need a lawyer with you to feel comfortable, then you can bring one.
